"The Photographer" refers to and represents Ultimate Images Photography, 33 Kingfisher Road, Upminster Essex RM14 1ER. "The Client" means any person, body of persons, firm or Company with whom the Photographer enters into a contract for the sale of goods or provision of services by the Photographer.
Ultimate Images own and retain the copyright to all the images we capture, unless at the time of booking a release is negotiated.
The images captured are protected in law and by purchasing the image either online or at an event you are purchasing the right to the photo, not the copyright and therefore have no rights to reproduce the photo in or on any medium. This includes, but is not restricted to scanning, copying, republishing, advertising, uploading, transmitting or displaying the image. Should you wish to undertake any re-use of the image in any way or on any medium then written permission must be obtained from Ultimate Images.
All contracts and transactions between the Photographer and the Client whether made orally or in writing are subject to these terms and conditions which shall be deemed to be incorporated into any contract between the Photographer and all or any of its Clients
If a booking is cancelled by the Client where a fee has been agreed within one working day of the starting time, the Photographer reserves the right to charge his full fee for the assignment. If a booking is cancelled within two working days of the starting time, the Photographer may charge 50% of his fee.
For cancellations/postponements due to weather conditions, the Photographer reserves the right to charge his full fee and expenses due to weather conditions on location. In such instances, the Photographer may charge in full for his expenses (e.g. including but not limited to; hire of specialist equipment, vehicles etc), that he may have incurred prior or during the assignment taking place.
Ultimate Images is committed to protecting your privacy. Any information gathered during your use of any of our services will not be sold, traded or rented to any third parties. All information supplied to us while completing any form on this site will be protected by secure server software as far as is reasonably practicable. By using this website you accept these terms.
Required Information
To fulfil any order placed with Ultimate Images the following information will be required – Name, Address, Address of recipient (if different) e-mail address, Contact telephone number, payment details (CC number, start and expiry dates, issue no and security no) All orders are subject to review and approval to ensure the shopping cart has applied to correct prices and discounts. If an error has occured we reserve the right to cancel the order. We may also contact you via e-mail no more than twice a year to inform you of changes to the site and offers / new products.
We currently only accept GBP £ as a currency
Ultimate images offer a 100% satisfaction guarantee on all images and products supplied. In the event of damage that has occurred during delivery please inform us immediately either by phone or e-mail and we will arrange a replacement. Where a high value item has been ordered (over £20) then the appropriate insurance cover must be purchased at the time the order is placed.
Should you not be happy with the image in any way we offer a full refund so long as we are notified within 28 days of the order being placed, we will then refund in full within 7 days
Digital images, Unfortunatly due the electronic delivery of these images a refund is not possible as you will have received the image and there is no way of returning an electronically delivered image. Please double check that you are totally happy with the image as displayed prior to placing the order
All material contained on this and all other websites owned and operated by Ultimate Images are protected by copyright laws and copyscape software. Any violation of this copyright will be reported to the appropriate authorities and ISP’s. No part of this website including all images, information, layout and feel of the site maybe copied or republished in any form. Any link to any page or image must first be approved by ultimate images. All links are monitored on a daily basis and any unauthorized links will be investigated.
Any links on this site do not represent an endorsement of the site or product referenced by the link. The following of any link is at the risk of the user and Ultimate Images accept no liability for the content of third party sites.
The Client agrees that in all dealings with the Photographer, the Photographer's liability will be limited to the following sums:
Public Liability: Limit of indemnity - £5,000.000
Professional Indemnity: Limit of indemnity - £25,000
The Client shall be responsible for the behavior of any persons accompanying them to an assignment. The Photographer reserves the right to terminate any assignment without notice if he deems the Clients behaviour to be unruly or unsafe. In such instances, the Photographer reserves the right to charge his full fees and expenses as described in clause 4 of these Terms and Conditions. The Client will fully reimburse the Photographer or his agents for any loss/damage they cause to property or equipment.
The supply of products and services are provided by the Photographer on a best endeavors basis. The Photographer will not be liable for delays that are beyond his reasonable control. The Photographer shall use reasonable endeavors to meet agreed deadlines where applicable. The Photographer shall not be liable for any delays in meeting any of his obligations which were due to causes beyond his reasonable control including but not limited to; postage/courier/lab delays, war/acts of terrorism, riots, government legislation, industrial action, adverse weather conditions, acts of God, floods, fire, loss or damage in transit etc.
The Photographer reserves the right to amend both Prices and these Terms and Conditions without prior notice.
The Photographer reserves the right make an additional charge should the Client request a rush service. This service is subject to availability and cannot be guaranteed.
For all images/data supplied to the Client in electronic format (including but not limited to electronic mail, CD's/DVD's etc), The Photographer will endeavor to ensure that the data sent is not corrupt and is virus-free by scanning the data with Norton Antivirus software before dispatch. The Photographer cannot be held responsible for any damage, disruption and/or loss of any kind that the said media may cause to the Clients computer or data. The Client agrees to take similar steps to ensure that data sent to the Photographer is not corrupt and/or virus-free. Due to the nature of the delivery method no refunds can be given for images supplied in a digital format
This Agreement shall be subject to and constructed according to English Law and the parties agree to accept the exclusive direction of the Courts of England
All images are cropped as the cameras native ratio is 3:2, so an 8x6 print will loose 1inch from the edges, and a 10x8 would loose 2 inches from the side. All images are therefore shot with this in mind, and will be cropped as we feel best. Should you request a specific crop i.e centralise horse - then please be aware that we will crop to that request so other parts of the image may be lost to accommodate that. Where a specific request has been made then these can't be returned. If we feel that the request will detract from the image then we will get in touch. If you wish use to supply a proof prior to printing then a fee of £5 is payable.
It is possible to manipulate images and to remove items from the background. This work however is at our discretion and can be chargeable. Costs start from £20 per image, please contact the office should you require clarification.
